These terms and conditions (“Terms”) govern the use of services made available on or through www.sevaki.in and/or the Sevaki mobile app (collectively, the “Platform”, and together with the services made available on or through the Platform, the “Services”).

These Terms also include our Privacy Policy, available at https://sevaki.in/privacy-policy.html (“Privacy Policy”), and any additional or supplemental terms, policies, and disclaimers made available or issued by us from time to time (“Supplemental Terms”). The Privacy Policy and the Supplemental Terms form an integral part of these Terms. In the event of a conflict between these Terms and the Supplemental Terms with respect to applicable Services, the Supplemental Terms will prevail.

The Terms constitute a binding and enforceable legal contract between Sevaki Technologies Private Limited (“Sevaki”, “we”, “us”, or “our”), and you, a user of the Services, or any legal entity that books services on behalf of end-users (“you” or “Customer”).

By using the Services, you represent that you have full legal capacity and authority to agree to and bind yourself to these Terms. If you represent another person or organization, you confirm that you have the necessary authority to bind such person or entity to these Terms.

By accessing or using the Services, you agree that you have read, understood, and are bound by these Terms and that you will comply with the requirements listed here. If you do not agree with these Terms, please do not use the Services.

1. SERVICES

(a) The Services include providing a digital Platform that enables users to arrange and schedule different home-based services with independent third-party service providers (“Service Professionals”). As part of the Services, Sevaki facilitates the transfer of payments to Service Professionals for the services they render.

(b) Sevaki does not directly provide these services and is not responsible for their provision. Service Professionals are independent contractors and not employees, agents, or partners of Sevaki.

(c) The Platform is intended for personal and non-commercial use within India, unless otherwise agreed upon in writing.

(d) Sevaki may contact you through SMS, email, or WhatsApp for communication, booking updates, or promotions. You can opt out via settings or email, but doing so may affect your access to some features.

(e) You may be required to provide valid identification to avail of Services or Pro Services.

2. ACCOUNT CREATION
  • (a) To use the Platform, you must create an account (“Account”) and be at least 18 years old.
  • (b) You agree to provide accurate details and promptly update them as needed.
  • (c) You are responsible for safeguarding your account credentials.
  • (d) Sevaki shall not be liable for unauthorized access to your Account.
  • (e) You agree to receive communications related to payments, promotions, and service updates.
3. USER CONTENT
  • (a) Users may post reviews, feedback, and comments (“User Content”).
  • (b) You must ensure your reviews are accurate and genuine.
  • (c) You grant Sevaki a worldwide, non-exclusive, royalty-free license to use and display such User Content.
  • (d) Sevaki may remove or restrict any content that violates these Terms.
4. CONSENT TO USE DATA
  • (a) You agree that Sevaki may collect, store, and process your data per its Privacy Policy.
  • (b) Sevaki may share data with affiliates or third-party partners as necessary.
  • (c) Data may be disclosed to law enforcement agencies if required by law.
5. BOOKINGS
  • (a) You can request services based on available slots. If no Service Professional is available, Sevaki will contact you for an alternative time.
  • (b) Booking confirmations will be shared via SMS, email, or push notifications.
  • (c) Cancellation fees may apply as per Sevaki’s Cancellation Policy.
  • (d) In case of unavailability, Sevaki may assign an alternate Service Professional.
6. PRICING, FEES, AND PAYMENT TERMS
  • (a) You agree to pay applicable service charges and fees as indicated during booking.
  • (b) Payments can be made via credit/debit card, UPI, wallets, or cash (where available).
  • (c) All prices include applicable taxes.
  • (d) Fees and charges are non-refundable unless stated otherwise.
  • (e) Sevaki may update pricing at any time without prior notice.
7. CUSTOMER CONDUCT
  • (a) You must treat Service Professionals respectfully and provide a safe, clean environment for services.
  • (b) Discrimination or abusive behavior is strictly prohibited.
  • (c) Sevaki reserves the right to block access for users who behave inappropriately.
8. THIRD-PARTY SERVICES
  • (a) The Platform may include third-party links or services. Sevaki is not responsible for their content or actions.
  • (b) You agree to be bound by third-party terms when using such services.
9. YOUR RESPONSIBILITIES

You agree to:

  • Provide accurate and truthful information.
  • Not misuse, copy, or distribute Platform content.
  • Not attempt unauthorized access or disrupt Platform operations.
  • Not solicit Service Professionals to work outside the Sevaki Platform.
10. OUR INTELLECTUAL PROPERTY

All rights, titles, and interests in the Platform and its content belong to Sevaki. You may not copy, modify, or distribute any part of it without written permission.

11. TERM AND TERMINATION
  • (a) Sevaki may suspend or terminate your account if you violate these Terms.
  • (b) You may terminate your account by contacting help.sevaki@gmail.com
  • (c) Termination does not affect rights or obligations accrued prior to termination.
12. DISCLAIMERS AND WARRANTIES
  • (a) Services are provided “as is” without warranties of any kind.
  • (b) Sevaki acts only as an intermediary between customers and Service Professionals.
  • (c) Sevaki is not responsible for service quality, timeliness, or damages caused by Service Professionals.
  • (d) Maximum liability of Sevaki shall not exceed INR 10,000.
13. INDEMNITY

You agree to indemnify and hold Sevaki and its affiliates harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of India.
All disputes shall be subject to arbitration in Hyderabad, India, in English, under the Arbitration and Conciliation Act, 1996.

15. MISCELLANEOUS
  • Updates: Sevaki may revise these Terms at any time.
  • Severability: If any clause is invalid, the rest remain in effect.
  • Force Majeure: Sevaki is not liable for delays beyond its control (e.g., natural disasters, network failures).
  • Assignment: Sevaki may assign rights and obligations to its affiliates or successors.
